  • LEGAL NOTICE The Montgomery Soil and Water Conservation District Board of Supervisors will be accepting bids from contractors for the construction of the North Clayton Group Drainage Project, consisting of approximately 16,000 feet of subsurface drainage tile and 100 feet of open ditch reconstruction. This is a Conservation Works of Improvement located in Section 26 Perry Township, Ohio, Montgomery County, Ohio. This project’s outlet is Bear Creek, approximately 1250 feet north of Old Dayton Road, and along the west side of Clayton Road. The Construction drawings and specifications for this project will be made available for review at the MSWCD office between the hours of 8:00 a.m. and 4:00 p.m., weekdays. Contractors wishing to secure a set of contract documents may do so by contacting MSWCD at (937) 854-7645 Ext 0518. A preparation fee of one hundred ($100.00) will be charged for each bid set. These documents may be picked up at the MSWCD office or be mailed for an additional shipping fee of twenty dollars ($20.00). Sealed bids, in single copy, the words North Clayton Road Group labeled on the front of the envelope can be filed at the Montgomery Soil and Water Conservation District (MSWCD) office, 10025 Amity Road, Brookville, Ohio 45309 until 1:00 p.m., Monday, November 30th, 2020. The bids shall be opened by the Project’s Contracting Officer or designee as soon thereafter as the opening can begin in the MSWCD conference room. Said bids shall be on the Unit Price Basis and shall be in writing on Bid Proposal Forms furnished by the MSWCD. Pursuant to Section 153.54, et seq., of the Ohio Revised Code (ORC), the Bidder shall submit a BID GUARANTY form of either: A bond, certified check, cashier’s check, or letter of credit on a solvent bank for 10% of the bid, conditioned that, if the bid is accepted, the bidder after the awarding or the recommendation for awarding the contract, will enter into and faithfully perform a proper contract based upon the bid: and indemnify the MSWCD Board against all damage suffered by failure to perform the contract by supplying a performance bond in accordance with Section 153.54, et seq. of the Ohio Revised Code for the FULL AMOUNT OF THE CONTRACT. Bid security furnished in Bond form, shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety. Each bid proposal shall contain the full name of the party or parties submitting the proposal and all persons interested therein. Each bidder shall submit evidence of its experiences on projects of similar size and complexity and submit three (3) references of work done on similar types of construction. The owner intends and requires that this project be completed no later than April 2, 2021. All contractors and subcontractors involved with the project will, to the extent practicable use Ohio products, materials, services, and labor in the implementation of their project. Additionally, contractor compliance with the Equal Employment Opportunity requirements of Ohio Administrative Code Chapter 123, the Governor’s Executive Order of 1972, and Governor’s Executive Order 8409 shall be required. Bidders shall comply with the prevailing wage rates of Public Improvements in Montgomery County, Ohio as determined by the Ohio Bureau of Employment Services, Wage and Hour Division, (614) 644-2239 The Bid Proposal, Contract Documents, General Provisions, Construction Specifications, Material Specifications, and the Construction Drawing set shall be incorporated in and become a part of the resultant contract. Each bidder shall attend the pre-bid meeting and will be conducted at 1:30 p.m. on Wednesday November 19, 2020, in the MSWCD conference room, and the Project View (walk-through) will immediately follow the pre-bid meeting. Bids shall be enclosed in a sealed envelope identified as North Clayton Road Group Drainage Project and MUST HAVE THE FULL NAME AND ADDRESS of the bidder on the envelope. The MSWCD Board reserves the right to reject any or all bids and to waive any irregularity of bids, including unbalanced bids, and to award the bid on the basis of the lowest and best bid it deems to be in the best interest of the Board and the project.
