- LEGAL NOTICE
The Montgomery Soil and Water Conservation District (MSWCD) Board of Supervisors will be accepting bids from contractors for the construction of the Little Farms Group Drainage Project, consisting of approximately 7,094 feet of subsurface drainage tile and 1,388 feet of ditch reconstruction. This is a Conservation Works of Improvement Project located in Section 5 of Jackson Township and Sections 29,31 and 32 of Perry Township, Montgomery County, Ohio. This project's outlet is in a tributary of Tom's Run on the south side of State Route 35, 832 feet south of the intersection of North Sulphur Springs Road and State Route 35. Sealed bids, in single copy, will be accepted at the MSWCD office, 10025 Amity Road, Brookville, Ohio 45309 until 1:30 P.M., September 29, 2011. The bids will be opened by the Project's Contracting Officer as soon thereafter as the opening can begin in the MSWCD conference room.
Said bids shall be on the Unit Price Basis and shall be in writing on Bid Proposal Forms furnished by the MSWCD.
Pursuant to Section 153.54, et seq., of the Ohio Revised Code (ORC), the Bidder shall submit a BID GUARANTY form of either:
A bond, certified check, cashier's check, or letter of credit on a solvent bank for 10% of the bid, conditioned that, if the bid is accepted, the bidder after the awarding or the recommendation for awarding the contract, will enter into and faithfully perform a proper contract based upon the bid: and indemnify the MSWCD against all damage suffered by failure to perform the contract by supplying a performance bond in accordance with section 153.54, et seq. of the Ohio Revised Code for the FULL AMOUNT OF THE CONTRACT. Bid security furnished in Bond form, shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety.
Each bid proposal must contain the full name of the party or parties submitting the proposal and all persons interested therein. Each bidder must submit evidence of its experiences on projects of similar size and complexity. The owner intends
and requires that this project be completed no later than January 9, 2012.
All contractors and subcontractors involved with the project will, to the extent practicable use Ohio Products, materials, services, and labor in the implementation of their Project. Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123, the Governor's Executive Order of 1972, and Governor's Executive Order 8409 shall be required.
Bidders must comply with the prevailing wage rates of Public Improvements in Montgomery County, Ohio as determined by the Ohio Bureau of Employment Services, Wage and Hour Division, (614) 644-2239.
The Bid Proposal, Contract Documents, General Provisions, Construction Specifications, Material Specifications, and the Drawing set will be incorporated in and become a part of the resultant contract.
The plans and specifications for this Project will be made available for review at the MSWCD office between the hours of 8:00 A.M. and 4:00 P.M., weekdays. Contractors wishing to secure a set of contract documents may do so by phoning the MSWCD office at (937) 854-7645. An administrative/preparation fee of one-hundred dollars ($100.00) will be charged for each bid set. These documents may be picked up at the MSWCD office or be mailed for a shipping and handling fee of twenty dollars ($20.00).
A mandatory pre-bid conference will be conducted on September 22, 2011, at 1:30 P.M., in the MSWCD office conference room. Potential bidders pay particular attention to the following provisions.
a) The bidder shall examine the plans and specifications prior to the pre-bid conference and be ready to raise questions concerning any unclear matter in the bidding process.
b) The bidder recognizes that the purpose of the pre-bid conference is to resolve ambiguities, inconsistencies, errors or omissions in the contract documents, and interpretations thereof shall be made with a preference to the accomplishment of the purpose of the contract, without additional cost to the MSWCD.
The construction bids shall be enclosed in a sealed envelope identified as the Little Farms Group Drainage Project and MUST HAVE THE FULL NAME AND ADDRESS of the bidder on the envelope. The MSWCD reserves the right to reject any or all bids and to waive any irregularity of bids, and to award the bid on the basis of the lowest and/or best bid it deems to be in the best interest of the MSWCD and the project. Upon qualification, contract documents shall be completed and submitted prior to the contract's awards.
