  • LEGAL NOTICE TO THE OWNERS of all real property situated within the Greater Moraine-Beavercreek Sewer District, Northwest Wolfcreek Sub-district, Montgomery County, Ohio: YOU ARE HEREBY NOTIFIED that the Board of County Commissioners has scheduled a Public Hearing for proceeding with the Phillipsburg Sanitary Project, Project No. 130023-15. This public hearing will be held on March 12, 2013 at 1:30 p.m., or as soon thereafter, in the Montgomery County Administration Building, tenth floor Hearing Room, 451 West Third Street, Dayton, Ohio 45422. That the Board finds and declares that the boundary of said improvement is as follows: Situate in Section 2, Town 6 North, Range 4 East, Village of Phillipsburg and Clay Township, County of Montgomery, Ohio and situate in Section 11, Town 6 North, Range 4 East, Village of Phillipsburg and Clay Township, County of Montgomery, Ohio: Being all of the Parcels within the Village Corporation limits with existing water using structures and Parcels Identified by the County Auditor as C06 00402 0123, C06 00411 0001, C06 00411 0003, C06 00411 0049, C06 00411 0053, C06 00411 0054, C06 00411 0056, C06 00411 0058, C06 00411 0059, C06 00411 0063. The improvements shall consist of the construction of sanitary sewer mains, fittings, appurtenances, lift station, and all necessary and incidental expenses thereto. More specifically being 12” sanitary sewer main on Main Street and State Street, 8” sanitary sewer main on all other streets and a 6” force main from the Village of Phillipsburg to U.S. 40. The properties to be benefited by the construction of said improvement constitutes all the property within the limits of described area. The properties within the herein described area in the County shall pay assessments, sewer rates and shall constitute the improvement area. This notice is given pursuant to Chapter 6117, 307, and 729 of the Ohio Revised Code. Plans, specifications, estimate of cost, and tentative assessments are on file and may be examined at Montgomery County Environmental Services, 1850 Spaulding Road, Kettering, Ohio 45432. The Board of County Commissioners will hear endorsements of or objections to the above project on the afore mentioned date of the public hearing. Gayle L.
