Marsh, et al., by deed recorded in Deed Microfiche No. 77-325A06 of the Records of Montgomery County, Ohio: thence with the east line of said Marsh land, North 0 deg. 07' 40" West for 538.51 feet to the northeast corner of said Marsh Land said corner being in the south line of land conveyed to Encrete Investment Company, Inc., and Woodley Development Company, Inc. by deed recorded in Deed Microfiche No. 75-096B09 of the Records of Montgomery County, Ohio; thence with the south line of said Encrete Investment Company, Inc., and Woodley Development Company, Inc., land, south 78 deg. 52'40" east for 130.97 feet; Thence south 0 deg. 49' 00" west for 512.70 feet to a point in the north line of said Thomas Paine Parkway; Thence with the north line of said Thomas Paine Parkway on a curve to the left with a radius of 530.00 feet for 10.61 feet, tangent to said curve at its point of beginning, bearing north 89 deg. 11'00" west; thence continuing with the north line of said Thomas Paine Parkway on a tangent bearing south 89 deg. 40'10" west for 109.40 feet to the point of beginning, containing 1.500 acres, more or less. PPN: O68 00605 0013 Now, therefore, public notice is hereby given that I, Phil Plummer, Sheriff of Montgomery County, Ohio, will sell such real property at public auction, for cash, to the highest bidder of an amount sufficient to satisfy the judgment against each parcel, at 10:00 A.M. in the County Administration Building, 10th Floor, 451 West Third Street, in the City of Dayton, Ohio 45402 on Thursday, June 2, 2011, to satisfy the judgment amount of $69,639.06, and if any parcel does not receive a sufficient bid, it shall be offered for sale, under the same terms and conditions of the first sale and at the same time of day and at the same place, on Thursday, July 7, 2011, for the amount of $70,035.26 to include all penalties and interest to satisfy the judgment against the parcel. This Court further orders the Sheriff of Montgomery County to publish an advertisement in the Daily Court Reporter of sale of the Parcel, which advertisement of sale shall include the date on which a second sale will be conducted if no bid is accepted at the first sale, once a week for three consecutive weeks and (ii) to sell the Parcel, without appraisal for not less than the amount due Plaintiff and in the manner provided by law for the sale of real property, pursuant to Ohio Revised Code Ann., Section 5721.19. The successful bidder must deposit $1,000 PLUS transfer and recording fees ($28.50) immediately following the sale. We will accept cash, certified check or a personal check with proper ID and signed in our presence for the deposit. The personal check must be drawn off of a local bank. The unpaid balance must be paid to the Montgomery County Sheriff by certified or cashier's check within thirty (30) days from the date the confirmation of sale is filed by the plaintiff's attorney.
