James P Hobstetter, Jr; Sherri L Hobstetter; Mollie Hobstetter; John Doe, unknown spouse, if any, of Mollie Hobstetter; Anne Hobstetter aka Ann Hobstetter; John Doe, unknown spouse, if any, of Anne Hobstetter aka Ann Hobstetter; Mary G Wentworth; John Doe, unknown spouse, if any of Mary G. Wentworth; Peter G Hobstetter; Marianne G Hobstetter; and Unknown Spouse, Heirs, Creditors, Executors, Administrators, Legatees and Devisees, if any, of James Hobstetter, aka James P. Hobstetter, Sr., deceased, whose last known address is unknown, will take notice that on the 19th day of October, 2017, Plaintiff filed its Complaint in Case No. 2017CV04911, in the court of Common Pleas Montgomery County, Ohio alleging that the Defendant(s), have or claim to have an interest in the real estate commonly known as 425 Ivycrest Terrace, Dayton, OH 45429, and also known as Parcel Number: N64-00913-0009 & N64-00913-0007, of the Auditor’s Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit “A” attached to Plaintiff’s mortgage filed in Instrument Number 06-067732, on the 24th day of July, 2006, in the Recorder’s Office of Montgomery County, Ohio.
The Complaint further alleges that by reason of default of the Defendant(s) James Hobstetter aka James P Hobstetter Sr, deceased and Dorothy Hobstetter aka Dorothy G Hobstetter, deceased, in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken, and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
The Defendant(s) named above are required to answer on or before the 19th day of January, 2018, or a judgment may be rendered as prayed for herein.
