  • LEGAL NOTICE In the Montgomery County Court of Common Pleas, Dayton, Ohio. Case No. 2016CV02974. PNC BANK NATIONAL ASSOCIATION SUCCESSOR BY MERGER TO NATIONAL CITY BANK, Plaintiff vs. PHUOC CAO AKA PHUOC H. CAO AKA PHUOC HUU CAO, et al., Defendants Tim Eichman whose last known address is 8175 Normandy Creek Drive, Dayton, OH 45458 and Jacqueline Pham whose last known address is 314 Hillcrest Drive, Springboro, OH 45066, will take notice that on the 14th of June, 2016 filed its Complaint in Case Number 2016CV02974 in the Montgomery County Common Pleas Court, alleging that Defendant(s) have or claim to have an interest in the real estate commonly known as 8175 Normandy Creek Drive, Centerville, OH 45458, and also known as Parcel Number 067-290-17-11 of the Auditor’s Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit “A” attached to the mortgage filed in Instrument Number 00-0871B02, on the 8th day of March, 2000 in the Recorder’s Office of Montgomery County, Ohio. The Complaint further alleges that by reason of default of the Defendant(s) Phuoc Cao aka Phuoc H. Cao aka Phuoc Huu Cao and and Kim Bui aka Kim H. Bui aka Kim Huong in the payment of a promissory note, according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken, and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other and further relief as is just and equitable. The Defendant(s) named above are required to answer on or before the 24th day of March, 2017, or a judgment may be rendered as prayed for herein. Robert K.
