SWISHER AS ADMINISTRATOR OF THE ESTATE OF LESLIE KEITH BRUNK AKA LESLIE K. BRUNK, DECEASED, et al., Defendants Jane Doe unknown spouse if any of Leslie Keith Brunk aka Leslie K. Brunk, deceased whose last known address is 8742 Washington Colony Drive, Dayton, OH 45458 and Legacy Mortgage whose last known address is PO Box 10304, Des Moines, IA 50306, will take notice that on the 12th of June, 2015, Plaintiff filed its Complaint in Case Number 2015CV03095 in the Montgomery County Common Pleas Court, alleging that Defendant(s) have or claim to have an interest in the real estate commonly known as 8742 Washington Colony Drive, Dayton, OH 45458, and also known as Parcel Number O67-503-6-39 of the Auditor’s Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit “A” attached to the mortgage filed in Instrument Number 06-111813, on the 5th day of December, 2006 in the Recorder’s Office of Montgomery County, Ohio. The Complaint further alleges that by reason of default of Leslie Keith Brunk aka Leslie K. Brunk, deceased in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of Plaintiff’s claim in the proper order of its priority and for such other and further relief as is just and equitable.
