Case No. 2015CV02395 Habitat Condominium Owners’ Association, Plaintiff vs. Elaine New, Executor of the Estate of John A King, Deceased, et al., Defendants Defendants, Unknown Heirs, Devisees, Legatees, Executors, Administrators, Spouses and Assigns and the Unknown Guardians of Minor and/or Incompetent Heirs of John A King, whose address is unknown, will take notice that on May 5, 2015, Habitat Condominium Owners’ Association filed its Complaint for Foreclosure in Case No. 2015CV02395 in the Court of Common Pleas of Montgomery County, Ohio, alleging that there is due to Habitat Condominium Owners’ Association, the sum of $4,787.82 in unpaid condominium maintenance fees and assessments as of April 29, 2015, plus subsequent unpaid fees, costs, and attorney fees, as owners of the property known as 3314 Ultimate Way, Dayton, Ohio 45449, being Permanent Parcel No. K45500010453 and further described as being: SITUATE IN MIAMI TOWNSHIP, MONTGOMERY COUNTY, OHIO AND BEING BUILDING NUMBERED THIRTY SIX (36), UNIT NUMBERED ONE (1), IN PARCEL VIII OF HABITAT CONDOMINIUMS AS SHOWN ON THE CONDOMINIUM DRAWINGS RECORDED IN PLAT BOOK 100, PAGE 34 AND AS SHOWN ON THE DECLARATION OF CONDOMINIUM OWNERSHIP, RECORDED IN MICROFICHE NO. 74-06A05, MONTGOMERY COUNTY DEED RECORDS AS AMENDED BY AMENDMENTS RECORDED AT MICROFICHE NO. 74-314A01, MICROFICHE NO. 75-119A01, MICROFICHE NO. 75-206B09, MICROFICHE NO. 76-204A01, MICROFICHE NO.76-211A01, AND MICROFICHE NO.76-530C06 MONTGOMERY COUNTY, OHIO DEED RECORDS TOGETHER WITH THE PERCENTAGE OF OWNERSHIP IN THE COMMON AREAS AND FACILITIES DECLARED BY THE DECLARATION TO BE AN APPURTENANCE TO THE ABOVE UNIT. Habitat Condominium Owners’ Association prays that the Defendants named above be required to answer and set forth their interest in said real estate or be forever barred from asserting the same, for foreclosure of Plaintiff’s condominium lien, marshalling of liens, and sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff’s claim in proper order of its priority, and for such other relief as is just and equitable. The defendants named above are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for three (3) consecutive weeks, with the last publication to be made on the 12th day of June, 2015.
