  • LEGAL NOTICE In the Montgomery County Court of Common Pleas, Dayton, Ohio. Case No. 2014CV04135 PNC BANK NATIONAL ASSOCIATION SUCCESSOR BY MERGER TO NATIONAL CITY BANK, Plaintiff vs. MARKO RICE, AS EXECUTOR OF THE ESTATE OF ANNETTE RICE, et al., Defendants Marko Rice, as Executor of the Estate of Annette Rice, whose last known address is 5450 Northford Road, Trotwood, OH 45426 and John Doe, unknown spouse, if any, of Annette Rice, deceased, whose last known address is 1101 Blairwood Avenue, Dayton, OH 45417, will take notice that on the 17th day of July, 2014, Plaintiff filed its Complaint in Case No. 2014CV04135 in the court of Common Pleas Montgomery County, Ohio alleging that the Defendant(s), have or claim to have an interest in the real estate commonly known as 1101 Blairwood Avenue, Dayton, OH 45417 and also known as Parcel Number: G27182160065 of the Auditor’s Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit “A” attached to Plaintiff’s mortgage filed in Instrument Number 06-074471 on the 11th day of August, 2006 in the Recorder’s Office of Montgomery County, Ohio. The Complaint further alleges that by reason of default of Annette Rice, deceased in the payment of a promissory note, according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken, and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other and further relief as is just and equitable. The Defendant(s) named above are required to answer on or before the 21st day of November, 2014, or a judgment may be rendered as prayed for herein. Robert K.
