  • LEGAL NOTICE In the Montgomery County Court of Common Pleas, Dayton, Ohio. Case No. 2014CV02950. Indian Creek Condominium Property Owners Association, Plaintiff vs. Melissa A McIntosh, et al., Defendants Defendants, Melissa A McIntosh and John Doe, Unknown Spouse, if any, of Melissa A McIntosh, whose address is unknown, will take notice that on May 18, 2014, Indian Creek Condominium Property Owners Association filed its Complaint in Case No. 2014CV02950 in the Court of Common Pleas of Montgomery County, Montgomery Clerk of Courts, Montgomery County Courthouse, 41 N. Perry St., Room 104, Dayton, OH 45422-5406, alleging that there is due to Indian Creek Condominium Property Owners Association, the sum of $5,830.77 in unpaid condominium maintenance fees and assessments as of May 20, 2014, plus subsequent unpaid fees, costs, and attorney fees, as owners of the property known as 1124 Eagle Feather Circle Unit A, Dayton, Ohio 45449, being Permanent Parcel No. K48504220025, and further described as being: Situate in the City of West Carrollton, County of Montgomery, State of Ohio and being building Numbered 6, Unit Numbered 157A in the Indian Creek Condominium, Phase Two, the declarations and drawings of which are recorded at Microfiche No. 80-175A10 of the Deed Records of Montgomery County, Ohio and Plat of which appears recorded in Plat Book “110”, pages 20 through 20C of the Plat Records of Montgomery County, Ohio, together with the grantors right, title and interest in the common areas and facilities of said condominium whether now owned or hereafter acquired as a result of amendment of or addition to said condominium or otherwise. Indian Creek Condominium Property Owners Association prays that the Defendants named above be required to answer and set forth their interest in said real estate or be forever barred from asserting the same, for foreclosure of Indian Creek Condominium Property Owners Association’s condominium lien, marshalling of liens, and sale of said real estate, and the proceeds of said sale applied to the payment of Indian Creek Condominium Property Owners Association’s claim in the proper order of its priority, and for such other relief as is just and equitable. The defendants named above are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for three (3) consecutive weeks, with the last publication to be made on the 18th day of July, 2014.
