  • LEGAL NOTICE In the Montgomery County Court of Common Pleas, Dayton, Ohio. Case No. 2014CV0922 PNC BANK N.A. SUCCESSOR BY MERGER TO NATIONAL CITY BANK, Plaintiff vs. MICHAEL A SMITH AKA MICHAEL ARLEN SMITH, et al., Defendants Jane Doe, Unknown Spouse, if any, of Michael A. Smith, whose last known address is 3540 Beachgrove Road, Moraine, OH 45439, will take notice that on the 14th of February, 2014, Plaintiff filed its Complaint in Case No. 2014CV00922 in the court of Common Pleas Montgomery County, Ohio alleging that the Defendant, have or claim to have an interest in the real estate commonly known as 3540 Beachgrove Road, Moraine OH 45439 and also known as Parcel Number: J44120914 0053 / J44120914 0052 of the Auditor’s Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit “A” attached to Plaintiff’s mortgage filed in Instrument Number 05-046833, on the 18th day of May, 2005 in the Recorder’s Office of Montgomery County, Ohio. The Complaint further alleges that by reason of default of the Defendant(s) Michael A. Smith aka Michael Arlen Smith in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale applied to the payment of Plaintiff's Claim in the proper order of its priority, and for such other and further relief as is just and equitable. The Defendant named above is required to answer on or before the 9th day of May 2014, or a judgment may be rendered as prayed for herein. Robert K.
