  • LEGAL NOTICE Magdalene E. Myers, Attorney In the Montgomery County Court of Common Pleas , Dayton, Ohio, Case No. 2013CV04255 Barclay Square Condominium Owners Association, Plaintiff vs Rhonda R. Ison, Deceased, et al., Defendants Unknown Heirs at Law, Devisees, Legatees, Executors or Administrators of Rhonda R. Ison, whose address is unknown, will take notice that on July 18, 2013, Barclay Square Condominium Owners Association filed its Complaint for Foreclosure in the Court of Common Pleas of Montgomery County, Ohio, alleging that there is due to Barclay Square Condominium Owners Association the sum of $4,653.88 in unpaid condominium maintenance fees and assessments plus subsequent unpaid fees, costs, and attorney fees, as owners of the property known as 2213 Crew Circle, Dayton, Ohio 45439, being permanent parcel no. K47 50517 0007, and further described as being: Situated in the Township of Miami, County of Montgomery and State of Ohio: Being unit numbered 2213 of Building E of Barclay Square Condominium as recorded in Plat Book 112, Page 37 of the Plat Records of Montgomery County, Ohio, and as shown in the Declaration as to condominium property, by-laws and drawings recorded as Deed No. 81-96A01 of the Deed Records of Montgomery County, Ohio, as amended by First Amendment to Declaration as to Condominium Property of Barclay Square Condominium recorded as Deed No. 81-311L06 of the Deed Records of Montgomery County, Ohio, together with an undivided interest in the common areas and facilities as defined in the Declaration as to Condominium Property, as amended as an appurtenance to the above described unit. Barclay Square Condominium Owners association prays that the Defendants named above be required to answer and set forth their interest in said real estate or be forever barred from asserting the same, for foreclosure of Barclay Square Condominium Owners Association's condominium lien, marshaling of liens, and sale of said real estate, and the proceeds of said sale applied to the payment of Barclay Square Condominium Owners Association's claim in the proper order of its priority, and for such other relief as is just and equitable. Defendants first hereinabove named are further notified that they are required to answer said Complaint within twenty-eight days after last publication, which shall be published once a week for three (3) consecutive weeks, with the last publication to be made on the 30th day of August, 2013 or they might be denied a hearing in this case.
