Sander, Attorney In the Montgomery County Court of Common Pleas , Dayton, Ohio, Case No. 2013CV03148 Colonial National Mortgage, a division of Colonial Savings, F.A., Plaintiff vs Lavon E. Sisler, et al., Defendants Unknown Heirs, Beneficiaries, Fiduciaries, Donees and Devisees of Thelma M. Sisler, deceased, whose last known addresses are unknown are hereby notified that Colonial National Mortgage, a division of Colonial Savings, F.A. filed a Complaint in the Common Pleas Court of Montgomery County, Ohio in Case No. 2013CV03148, against them, alleging that on the 16th day of February, 2004, Lavon E. Sisler and Thelma M. Sisler executed to Colonial National Mortgage, a division of Colonial Savings, F.A., a promisory note, which Plaintiff is the holder of; Defendant Lavon E. Sisler and Thelma M. Sisler have defaulted in the payment of said note, and there is due Plaintiff thereon $55, 487.72 with interest at the rate of 6% per annum from the 1st day of December, 2012; that in order to secure the promissory note, Lavon E. Sisler and Thelma M. Sisler executed and delivered to Colonial National Mortgage, a division of Colonial Savings, F.A., a mortgage deed, and conveyed the following described real estate: Legal Description: Situate in the City of Dayton, County of Montgomery and State of Ohio, and being Lot Numbered 26173 and 26174 of the consecutive numbers of lots on the Rivised Plat of said City of Dayton. Subject to all covenants, conditions, restrictions, reservations, easements of record and to all legal highways. Be the same more or less, but subject to all legal highways. PPN: R72 04410 0012. Property address is: 312 Burkhardt Ave., Dayton, Ohio Plaintiff says that said mortgage was delivered to the recorded of Montgomery County, Ohio on the 18th day of February, 2004 and was recorded as Instrument No. 04-017261 Recorder’s Office, Montgomery County, Ohio and is the first and best lien on said premises save the lien of taxes and assessments and the costs of this action. The by reason of the failure of the Defendant Lavon E. Sisler and Thelma M. Sisler to make the monthly payments as required, the Plaintiff has declared the entire amount due and mortgage securing such note to be absolute; that the Treasurer of Montgomery County, Ohio; may have a claim against said premises. Therefore, Plaintiff prays for judgment against Defendant Lavon M. Sisler in the sum of $55, 487.72 on the note set forth in the First Cause of Action, together with interest at the rate of 6% per annum from December 1, 2012 plus interest, late charges, advances and penalties as provided for in such note and mortgage, and for “in rem” as to the Unknown Heirs, Beneficiaries, Fiduciaries, Donees and Devisees of Thelma M Sisler, deceased; that the mortgage set forth in the Second Cause of Action be foreclosed and all equities of redemption be forever cut off; that Plaintiff be found to have the first and best lien herein, and that the priority of all liens be determined by the Court; that said premises be sold as upon execution free and clear of all liens, interest and dower, and the proceeds thereof applied to the Plaintiff’s claim set out in the foregoin complaint and the Plaintiff may have such other an further relief to which it may be entitled at law or in equity. Defendants first hereinabove named are further notified that they are required to answer said Complaint within twenty-eight days after last publication, which shall be published once a week for three (3) consecutive weeks, with the last publication to be made on the 9th day of August, 2013 or they might be denied a hearing in this case.
