Burton Revocable Living Trust, Address Unknown whose last place of residence is unknown and whose present place of residence is unknown, will take notice that on May 17, 2013, WESBANCO BANK, INC., AS SUCCESSOR-IN-INTEREST BY MERGER TO OAK HILL BANKS filed its Complaint in Case No 2013 CV 03066 in the Court of Common Pleas of Montgomery Clerk of Courts, Montgomery County, Courthouse, 41 N. Perry St., Dayton, OH 45422-5406 seeking foreclosure and alleging that the Defendants Unknown Trustee(s), if any, of the Charles William Burton and Margaret E. Burton Revocable Living Trust, Address Unknown have or claim to have an interest in the real estate described below:
Legal Description: Situate in Section 23, Town 3, Range 4E, German Township, Montgomery County,Ohio, and being part of a 21.58 acre tract of land conveyed to Jeanne E. Burton by deed recorded in M.F. #00-0048 E04 of the Montgomery County Deed Records, said tract being more particularly described as follows:
Beginning at a stone found at the northeast corner of the southwest quarter section of Section 23; thence S 5 deg. 00’ 00” E with said half-section line for a distance of 1979.23 feet to a PK nail set on the centerline of Friend Road (passing a 1 ½” pipe found at 708.23 feet, and passing a 1” pipe found at 1872.22 feet on the centerline of Friend Road), said PK nail being at the true place of beginning for the herein described tract;
Thence from said true place of beginning, continuing with the centerline of Friend Road, S 5 deg. 00’ 00” E for a distance of 280.00 feet to a railroad spike found at the northeast corner of a 5.686 acre tract of land conveyed to Marlin D. and Marla Raisch by deed recorded by deed recorded in M.F. #96-746 E09 of the Montgomery County Deed Records; thence N 75 deg. 51’ 17” W with said Raisch north line for a distance of 597.36 feet to an iron pin set (passing an iron pin set at 15.88 feet on the west right-of-way of Friend Road); thence with new division lines for the following courses:
1. N 3 deg. 26’30” W for a distance of 183.95 feet to an iron pin set;
2. S 84 deg. 53’01” E for a distance of 568.15 feet (passing an iron pin set at 552.91 feet on the west right-of-way of Friend Road) to the true place of beginning, containing 3.000 acres, more or less, subject however to all highways, easements, and restrictions of record.
The above description is a result of a survey, September, 2000 by John T. Burkhardt, Registered Surveyor No. 6487. All iron pins set are 5/8” x 30” rebar capped “JTB S-6487”. Basis of Bearing: Centerline of Friend Road as recorded in M.F. #00-048 E04 (S 5 deg. 00’00”E).
