Case No. 2012CV07827 Flagstar Bank, FSB, Plaintiff vs. Geoffrey Kendall, et al, Defendants Defendant The Unknown Heirs, Devisees, Legatees, Administrators, Executors, and Assigns, if any, of Geoffrey Kendall, deceased, whose address is unknown, will take notice that on October 31, 2012, Flagstar Bank, FSB, filed its Complaint in Case No. 2012CV07827 in the court of Common Pleas Montgomery County, Ohio alleging that the Defendants, The Unknown Heirs, Devisees, Legatees, Administrators, Executors, and Assigns, if any, of Geoffrey Kendall, deceased, whose identity and address is unknown, has or claims to have an interest in the real estate described below: Legal Description: Situated in the State of Ohio, County of Montgomery, City of Dayton and being Twenty Feet taken by parallel lines off the West of Lot Numbered 42155 and Twenty Feet taken by parallel lines off the East of Lot Numbered 42154, both lots being of the consecutive numbers of lots on the revised plat of the City of Dayton. Permanent Parcel Number: R72 06202 0029; and R72 06202 0030 (Combined) Property Address: 60 East Beechwood Avenue, Dayton, Ohio 45405. Prior Deed Reference: Official Record Volume 07-051413. The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute. The Petitioner prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff’s Claim in the proper order of its priority, and for such other and further relief as is just and equitable.
