  • LEGAL NOTICE In the Court of Common Pleas of Montgomery County, Case No. 2012 CV 03862 THE CARILLON HOUSE ASSOCIATION, INC. VS. ROBERT M. POOL, ET AL. Unknown heirs, devisees, legatees, executors, administrators, spouses and assigns and the unknown guardians of minor and/or incompetent heirs of Robert M. Pool, whose address is unknown, will take notice that on May 29, 2012, The Carillon House Association, Inc. filed its Complaint for Foreclosure in the Court of Common Pleas of Montgomery County, Ohio, alleging that there is due to The Carillon House Association, Inc. the sum of $7,350.92 in unpaid condominium maintenance fees and assessments plus subsequent unpaid fees, costs, and attorney fees, as owners of the property known as 2230 South Patterson Boulevard, #94, Dayton, Ohio 45409, being permanent parcel no. N64 50101 0094, and further described as being: BEING UNIT NUMBERED NINETY-FOUR (94) OF THE CARILLON HOUSE CONDOMINIUM, THE DECLARATION DRAWINGS, ARTICLES OF INCORPORATION AND BY-LAWS OF WHICH ARE RECORDED AT MICROFICHE NO. 73-208-C05 OF THE DEED RECORDS IN THE OFFICE OF THE RECORDER OF MONTGOMERY COUNTY, OHIO. SUBJECT TO ALL EASEMENTS, CONDITIONS, COVENANTS AND RESTRICTIONS OF RECORD, TO ALL HIGHWAYS AND ZONING RESTRICTIONS; AND SUBJECT TO ALL OF THE PROVISIONS CONTAINED IN THE DECLARATION OF CONDOMINIUM AND IN THE ARTICLES OF INCORPORATION AND BYLAWS OF THE OWNERS’ ASSOCIATION. The Carillon House Association, Inc. prays that the Defendants named above be required to answer and set forth their interest in said real estate or be forever barred from asserting the same, for foreclosure of The Carillon House Association, Inc.’s condominium lien, marshalling of liens, and sale of said real estate, and the proceeds of said sale applied to the payment of The Carillon House Association, Inc. claim in the proper order of its priority, and for such other relief as is just and equitable. The defendants are required to answer within 28 days after last publication which shall be published once a week for three consecutive weeks, with the last publication date to be the 21st day of September, 2012.
