  • LEGAL NOTICE In the Montgomery County Court of Common Pleas, Dayton, Ohio. Case No. 2012CV03853 PNC BANK N.A. SUCCESSOR BY MERGER WITH NATIONAL CITY BANK, Plaintiff vs. Betty J. McCalister, et al., Defendants John Doe, Unknown Spouse, if any, of Betty J. McCalister, whose last known address is 1515 Fauver Avenue, Dayton, Ohio 45410, will take notice that on the 25th of May, 2012, Plaintiff filed its Complaint in Case No. 2012CV03853 in the court of Common Pleas Montgomery County, Ohio alleging that the Defendant, have or claim to have an interest in the real estate commonly known as 1515 Fauver Avenue, Dayton, OH 45410 and also known as Parcel Number: R72 15103 0034 of the Auditor’s Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit “A” attached to Plaintiff’s mortgage filed in Mort 08-023942, on the 4th day of April, 2008 in the Recorder’s Office of Montgomery County, Ohio. The Complaint further alleges that by reason of default of the Defendant Betty J. McCalister in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken, and the same has become absolute. The Complaint prays that the Defendant named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale applied to the payment of Plaintiff's Claim in the proper order of its priority, and for such other and further relief as is just and equitable. The Defendant named above is required to answer on or before the 10th day of August. 2012, or a judgment may be rendered as prayed for herein. Robert K.
