  • LEGAL NOTICE In the Common Pleas Court of Montgomery County, Dayton, Ohio, Case No. 2011CV01185. American Tax Funding, LLC, Plaintiff -vs- Ronald G. Sorrell, et al., Defendants Lomas Mortgage USA, Inc., whose last known address is 717 N. Harwood Street, Suite 1800, Dallas, Texas 75201, shall take notice that, on the 14th day of February, 2011, American Tax Funding, LLC, filed its Complaint for Foreclosure in Case No. 2011CV01185 in the Court of Common Pleas to foreclose the lien(s) held by it for delinquent real estate taxes, assessments, penalties, interest, charges, and costs with respect to the following parcel of real property: Situated in the County of Montgomery, in the State of Ohio and in the City of Dayton and bounded and described as follows: Situated in Section 28, Town 2, Range 6 East, beginning on the north line of Neal Avenue at a point 185.7 feet west of the northwest corner of Neal Avenue and Squirrel Road, said point being the southwest corner of Ben G. Schieble's lot as recorded in Deed Book 472 at page 224 of the Montgomery County Records; Thence Northwardly for a distance of 157 feet along said Schieble's west line and said line extended northwardly, which said line is 175 feet (measured at right angles) westwardly from and parallel to the west line of Squirrel Road; Thence westwardly at right angles, for a distance of 47.05 feet to a corner; Thence southwardly on a line parallel to the west line of Squirrel Road for a distance of 140.1 feet, more or less, to the north line of Neal Avenue; Thence eastwardly along the north line of Neal Avenue for a distance of 50 feet, to the place of beginning. The property is known for street numbering purposes as 321 Neal Avenue, Dayton, Ohio 45405 and is further identified as Parcel No. R72 06712 0019 ("Certificate Parcel"). The prayer of the Complaint is for an order directing that the property be sold at public auction and that the proceeds therefrom be used to satisfy Plaintiff's lien(s). Plaintiff further prays for such other relief as the Court may deem just, equitable, and necessary and that any and all persons claiming an interest in the property be required to answer and set up their interest or be forever barred from asserting the same, that Plaintiff's lien(s) be found to be good and valid first lien(s) on the property, and that the equity of redemption with respect to the property be foreclosed. The above-named Defendants are required to answer Plaintiff's Complaint within twenty-eight (28) days after the last date of publication of this notice, which notice shall be made once per week for three consecutive weeks.
