  • NOTICE OF COMPLAINT FOR FORECLOSURE OF REAL ESTATE MORTGAGE FAIR DEBT COLLECTION NOTICE In the Common Pleas Court of Montgomery County, Dayton, Ohio Case No. 2011CV03690 Unknown Heirs, Successors and/or Assigns of Clarence Young III, whose last known places of residence are unknown, hereby take notice that on May 20, 2011, CODE Credit Union, Inc., an Ohio non-profit corporation, filed its Complaint for Foreclosure of Real Estate Mortgage in the Common Pleas Court of Montgomery County, Ohio, being Case No. 2011CV03690, alleging that there is due to the Plaintiff the sum of $34,204.62 plus interest at the rate of 4.990% per annum ($4.6762 per day) from May 13, 2011, plus any taxes, insurance premiums, or other similar necessary charges advanced by Plaintiff, applicable to the terms of the underlying Note, which is secured by a Mortgage conveying the following described property to Plaintiff, to-wit: Situated in the City of Dayton, County of Montgomery, State of Ohio and being one hundred five (105) feet taken by parallel lines off the west end of lot numbered thirteen thousand eight hundred sixty-eight (13868) of the revised plat of the City of Dayton, Ohio. Parcel ID No. R72-076080025 The Plaintiff further alleges that by reason of the default under the terms of the Note referenced above, the conditions of said Mortgage have been broken and the same has become absolute. Plaintiff prays that the Defendants named above be required to answer and set forth any interest in said real estate, or be forever barred from asserting the same, for foreclosure of said mortgage, marshaling of liens, and the sale of said real estate and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other relief as is just and equitable.
