  • LEGAL NOTICE In the Common Pleas Court of Montgomery County, Dayton, Ohio, Case No. 2011CV00757. American Tax Funding, LLC, Plaintiff -vs- Dorothy Stewart, et al., Defendants Dorothy Stewart and Unknown Spouse of Dorothy Stewart, whose last known address is 2733 Cain, Youngstown, Ohio 44511; Unknown Tenant or Land Contract Vendee No. 1, whose last known address is 849 Kumler Avenue, Dayton, Ohio 45402; and Unknown Tenant or Land Contract Vendee No. 2, whose last known address is 851 Kumler Avenue, Dayton, Ohio 45402, shall take notice that, on the 28th day of January, 2011, American Tax Funding, LLC, filed its Complaint for Foreclosure in Case No. 2011CV00757 in the Court of Common Pleas to foreclose the lien(s) held by it for delinquent real estate taxes, assessments, penalties, interest, charges, and costs with respect to the following parcel of real property: Situated in the City of Dayton, County of Montgomery and State of Ohio: And being Lot No. 39877 of the consecutive numbers of lots on the revised plat of the said City of Dayton. The property is known for street numbering purposes as 849 851 Kumler Avenue, Dayton, Ohio 45402 and is further identified as Parcel No. R72 07708 0056 ("Certificate Parcel"). The prayer of the Complaint is for an order directing that the property be sold at public auction and that the proceeds therefrom be used to satisfy Plaintiff's lien(s). Plaintiff further prays for such other relief as the Court may deem just, equitable, and necessary and that any and all persons claiming an interest in the property be required to answer and set up their interest or be forever barred from asserting the same, that Plaintiff's lien(s) be found to be good and valid first lien(s) on the property, and that the equity of redemption with respect to the property be foreclosed. The above-named Defendants are required to answer Plaintiff's Complaint within twenty-eight (28) days after the last date of publication of this notice, which notice shall be made once per week for three consecutive weeks.
