  • LEGAL NOTICE In the Common Pleas Court of Montgomery County, Dayton, Ohio, Case No. 2010CV08697. American Tax Funding, LLC, Plaintiff -vs- Estate of Hodges H. Bearden, et al., Defendants Estate of Hodges H. Bearden, whose last known address is c/o Hodges Hawkins Bearden, Jr., Executor, 2498 Hughes Court, Atlanta, Georgia 30331; Unknown Heirs, Devisees, Grantees and/or Assigns of Hodges H. Bearden and Unknown Heirs, Devisees, Grantees and/or Assigns of Vera Elizabeth Bearden, whose last known address is unknown; Hodges Hawkins Bearden, Jr., whose last known address is 2498 Hughes Court, Atlanta, Georgia 30331; and Unknown Tenant or Land Contract Vendee, whose last known address is 1531 Kumler Avenue, Dayton, Ohio 45406, shall take notice that, on the 3rd day of November, 2010, American Tax Funding, LLC, filed its Complaint for Foreclosure in Case No. 2010CV08697 in the Court of Common Pleas to foreclose the lien(s) held by it for delinquent real estate taxes, assessments, penalties, interest, charges, and costs with respect to the following parcel of real property: Situated in the City of Dayton, County of Montgomery and State of Ohio: Being Lot No. 46,424 of the consecutive number of lots on the revised Plat of the said City of Dayton, Ohio. The property is known for street numbering purposes as 1531 Kumler Avenue, Dayton, Ohio 45406 and is further identified as Parcel No. R72 11809 0044 ("Certificate Parcel"). The prayer of the Complaint is for an order directing that the property be sold at public auction and that the proceeds therefrom be used to satisfy Plaintiff's lien(s). Plaintiff further prays for such other relief as the Court may deem just, equitable, and necessary and that any and all persons claiming an interest in the property be required to answer and set up their interest or be forever barred from asserting the same, that Plaintiff's lien(s) be found to be good and valid first lien(s) on the property, and that the equity of redemption with respect to the property be foreclosed. The above-named Defendants are required to answer Plaintiff's Complaint within twenty-eight (28) days after the last date of publication of this notice, which notice shall be made once per week for three consecutive weeks.
