  • NOTICE OF SALE UNDER JUDGMENT OF FORECLOSURE OF LIENS FOR DELINQUENT LAND TAXES In the Common Pleas Court of Montgomery County, Ohio: Case No. 2010CV08497. Oberer Land Developers, LTD. vs. Lakisha Dewitt, Defendants. WHEREAS, Judgment has been rendered against certain parcels of real property to be sold without appraisement for no less than the total amount of taxes, assessments, penalties and interest plus the cost of this action. Permanent parcel number: R72-024-03-0023 and R72-024-03-0024. Street Address: 54 Dover Street, Dayton, Ohio 45410. Legal Description: Situated in the City of Dayton in the County of Montgomery in the State of Ohio and being eleven (11) feet taken by parallel lines off the south side of Lot Numbered Fourteen Thousand Five Hundred Seventy (14,570) and eleven (11) feet taken by parallel lines off the North side of Lot numbered Fourteen Thousand Five hundred Seventy One (14,571), both of said lot numbers being the consecutive numbers of lots on the revised plat of the said City of Dayton, Ohio: EXCEPTING THEREFROM that portion conveyed to The Dayton Street Railway Company in two tracks by deeds of October 21, 1907 and August 15, 1908, being recorded in the Deed Records of Montgomery County, Ohio in Deed Book 302, Page 20 and in Deed Book 306, Page 259, respectively, and described as follows: Situated in the City of Dayton, County of Montgomery and State of Ohio and being the Southeast portion of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14,570) and the Northeast part of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14,571); more particularly described as follows: Beginning on the East line of said Lot Numbered Fourteen Thousand Five Hundred Seventh (14,570) at a point thirty two (32) feet South of the Northeast corner of said Lot; thence in a Southwesterly direction crossing the South line of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14,570) and extending to a point on the South line of the North eleven (11) feet of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14,571), said point being fifty (50) feet West of the East line of the Lot Numbered Fourteen Thousand Five Hundred Seventy One (14,571), or thirty eight (38) feet west of the Southwest point of the part owned by The Dayton Street Railway Company; thence Eastwardly along the South line of said eleven (11) foot portion of said Lot numbered Fourteen Thousand Five Hundred Seventy One (14,571), fifty (50) feet to the East line of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14,571); thence Northwardly along the East line of said Lots Numbered Fourteen Thousand Five Hundred Seventy (14,570) and Fourteen Thousand Five Hundred Seventy One (14,571), twelve (12) feet; (being eleven (11) feet off both said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14,571), and one foot off of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14,570) to the place of beginning - being the same real estate described in deed recorded in Deed Book 1757, page 512 of the Deed Records of Montgomery County, Ohio. Parcel Number: R72-024-03-0023 and R72-024-03-0024 ("Certificate Parcel"). Now, therefore, public notice is hereby given that I, Phil Plummer, Sheriff of Montgomery County, Ohio, will sell such real property at public auction, for cash, to the highest bidder of an amount sufficient to satisfy the judgment against each parcel, at 10:00 A.M. in the County Administration Building, 10th Floor, 451 West Third Street, in the City of Dayton, Ohio 45402 on Thursday, June 2, 2011, to satisfy the judgment amount of $12,920.05, and if any parcel does not receive a sufficient bid, it shall be offered for sale, under the same terms and conditions of the first sale and at the same time of day and at the same place, on Thursday, July 7, 2011, for the amount of $12,958.27 to include all penalties and interest to satisfy the judgment against the parcel. This Court further orders the Sheriff of Montgomery County to publish an advertisement in the Daily Court Reporter of sale of the Parcel, which advertisement of sale shall include the date on which a second sale will be conducted if no bid is accepted at the first sale, once a week for three consecutive weeks and (ii) to sell the Parcel, without appraisal for not less than the amount due Plaintiff and in the manner provided by law for the sale of real property, pursuant to Ohio Revised Code Ann., Section 5721.19. The successful bidder must deposit $1,000 PLUS transfer and recording fees ($28.50) immediately following the sale. We will accept cash, certified check or a personal check with proper ID and signed in our presence for the deposit. The personal check must be drawn off of a local bank. The unpaid balance must be paid to the Montgomery County Sheriff by certified or cashier's check within thirty (30) days from the date the confirmation of sale is filed by the plaintiff's attorney.
