To: John Doe, unknown spouse, if any, of Anne E. Erli, aka Anne E. Fisher, whose last known places of residence 7115 North Dixie Drive, Apt. H, Dayton, Ohio 45414; 426 Grove Avenue, Dayton, Ohio 45404 and 1835 Hillsdale Ave., Dayton, Ohio 45414 you will take notice that on the 13th day of January, 2011, Plaintiff, filed a Complaint for foreclosure in the Montgomery County Court of Common Pleas, being Case No. 2011CV00326, alleging that there is due to the Plaintiff the sum of $58,276.39, plus interest at 6.8% per annum from January 1, 2010, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 426 Grove Avenue, Dayton, Ohio 45404, being permanent parcel number R72-52-11-5
Plaintiff further alleges that by reason of a default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendant is required to file an Answer on or before the 1st day of June, 2011.
