  • LEGAL NOTICE In the Common Pleas Court of Montgomery County, Dayton, Ohio. Case No. 2011CV01666 PNC Bank, N.A., successor by merger with National City Bank, Plaintiff vs. Unknown Spouse, Heirs, Creditors, Executors, Administrators, Legatees, and Devisees, if any, of Ira W. Wilkerson, et al., Defendants Unknown Spouse, Heirs, Creditors, Executors, Administrators, Legatees, and Devisees, if any, of Ira W. Wilkerson and Unknown Heirs, Creditors, Executors, Administrators, Legatees and Devisees, if any, of Daisy Wilkerson, whose last known address is unknown, will take notice that on the 3rd day of March, 2011, Plaintiff filed its Foreclosure Complaint in Case Number 2011CV01666 in the Montgomery County Common Pleas Court, alleging that Defendant(s) have or claim to have an interest in the real estate commonly known as 1537 Huffman Avenue, Dayton, Ohio 45403, and also known as Parcel Number R72 04302 0038 of the Auditor's Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's mortgage recorded at Microfiche 08-022542, on the 31st day of March, 2008. The Complaint further alleges that by reason of default of the account of Ira W. Wilkerson and Daisy Wilkerson, in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of Plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable. The Defendant(s) named upon are required to answer on or before the twenty-eighth day following the last date of publication, or the 2nd day of May, 2011, or a judgment may be rendered as prayed for herein.
