Case No. 2011CV00347 BAC Home Loans Servicing, L.P., fka Countrywide Home Loans Servicing, L.P., Plaintiff vs. Lillian Palatas, et al., Defendants Defendants, Lillian Palatas and John Doe, Real Name unknown, the Unknown Spouse, if any, of Lillian Palatas, whose last known addresses are 150 Chris Drive, Apt. 118, Englewood, Ohio 45322 and 4717 Olive Road, Dayton, Ohio 45426 and John Doe and/or Jane Doe, Real Names Unknown, The Unknown Heirs, Devisees, Legatees, Administrators, Executors and Assigns of Lillian Palatas, Deceased, whose identities and addresses are unknown, will take notice that on January 28, 2011, BAC Home Loans Servicing, L.P., fka, Countrywide Home Loans Servicing, L.P., filed its Amended Complaint in Case No. 2011CV00347, Montgomery County, Ohio, alleging that the defendants, Lillian Palatas, John Doe, Real Name unknown, the Unknown Spouse, if any, of Lillian Palatas and John Doe and/or Jane Doe, Real Names unknown, The Unknown Heirs, Devisees, Legatees, Administrators, Executors and Assigns of Lillian Palatas, deceased, have or claim to have an interest in the real estate described below: PREMISES COMMONLY KNOWN AS: 4717 Olive Road, Dayton, Ohio 45426. PERMANENT PARCEL NUMBER: H33-00508-0002 The plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute. The plaintiff demands that the defendant named above be required to answer and set up his interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.
