  • LEGAL NOTICE In the Court of Common Pleas, Montgomery County, Ohio, Case No. 2010CV08264 M & I Bank, FSB, Plaintiff -vs- Steven W. Ruyle, et al., Defendants Steven W. Ruyle and Nerie R. Ruyle, whose last address is 6754 Deer Ridge Drive, Huber Heights, Ohio 45424, otherwise whose place of residence is unknown and cannot by reasonable diligence be ascertained, will take notice that on October 18, 2010, the Plaintiff M & I Bank, FSB, filed its petition against them in the Court of Common Pleas of Montgomery County, Ohio, the same being Case No. 2010CV08264 in said Court, alleging that there is due the Plaintiff the sum of $178,707.19 plus interest and any sums advanced on a note secured by a mortgage deed of even date conveying the following described property, to-wit: Permanent Parcel Number; P70-00704-0003; Property Address: 6754 Deer Ridge Drive, Huber Heights, Ohio 45424. The legal description may be obtained from the Montgomery County Auditor at 451 W. Third Street, Dayton, Ohio 45422. The Complaint further alleges that by reason of the default of the Defendant obligors in the payment of said note according to its tenor, the conditions of said mortgage deed have been broken and the same has become absolute. Plaintiff prays that the Defendants named above be required to answer and set up their interest in said real estate, or be forever barred from asserting the same, for foreclosure of said mortgage, marshalling of liens and sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other and further relief as is just and equitable. Said parties are required to answer within 28 days after last publication , which shall be published once a week for three consecutive weeks in the Daily Court Reporter. Robert J.
