Daniels, Deceased, whose Identities and Addresses are Unknown, will take notice that on November 24, 2010, Bank of America, N.A., Successor by Merger with LaSalle Bank Midwest, NA, filed its Amended Complaint in Case No. 2010CV07312, Montgomery County, Ohio, alleging that the defendants, Michael E. Daniels, Jane Doe, Real Name Unknown, The unknown Spouse, If Any, of Michael E. Daniels and John Doe and/or Jane Doe, Real Names unknown, The Unknown Heirs, Devisees, Legatees, Executors, Administrators and Assigns of Michael E. Daniels, Deceased, have or claims to have an interest in the real estate described below: PREMISES COMMONLY KNOWN AS: 5109 MALIBU COURT, TROTWOOD, OHIO 45426. PERMANENT PARCEL NUMBER: H33-01323-0026 The plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute. The plaintiff demands that the defendant named above be required to answer and set up his interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.
