In pursuance of an order issued from Common Pleas Court, within and for the County of Montgomery, State of Ohio, made at the September term thereof, 2010, and to me directed, I will offer for sale at Public Auction in the Lower Level Auditorium of the Montgomery County Administration Building, 451 West Third Street in the City of Dayton, Ohio 45402 on Friday, January 28, 2011 at 10 o'clock A.M. of said day, the following Real Estate, to-wit: Situated in the County of Montgomery in the State of Ohio and in the City of West Carrollton: and being Lot Numbered Three Thousand Four Hundred Two (3402) of the consecutive numbers of lots on the revised plat of the said City of West Carrollton, Ohio. Parcel No. K48-7-1-1. Improved with 1 story single family, brick exterior, slab, 6 room (3 bedroom, 2 bath) gas heat, central air, attached 1 car garage, built in 1972. Located at 338 Ridgecrest Drive, West Carrollton, ohio 45449. Said property has been appraised at $84,000.00 and cannot sell for less than two-thirds of appraisement. This appraisal is based upon a visual inspection of that part of the premises to which access was readily available. The appraisal did not include an examination of the interior of the property. The appraisers assume no responsibility for, and give no weight to, unknown legal matters, including, but not limited to, concealed or latent defects, and/or the presence of harmful or toxic chemicals, pollutants, or gases. Terms of Sale: The successful bidder must deposit 10% of the purchase price plus transfer and recording fees immediately following the sale. We will accept cash, certified check or a personal check with proper ID and signed in our presence for the deposit. The personal check must be drawn off of a local bank. If you wish to put the property in a persons name not attending the sale you must have power of attorney to do so. The required 10% deposit is waived where the purchaser is the first lienholder. The unpaid balance of the purchase price must be paid to the Montgomery County Sheriff by certified or cashier's check within thirty (30) days of the filing of the confirmation entry. The plaintiff's attorney will prepare the confirmation entry and the deed. The Montgomery County Sheriff's Office will transfer and record all deeds.
