  • NOTICE OF FORECLOSURE In the Common Pleas Court of Montgomery County, Ohio, Case No. 2010CV08497 Oberer Land Developers, LTD, Plaintiff -vs- Lakisha DeWitt, Defendant JOHN DOE, the unknown spouse of Lakisha DeWitt; The Unknown Tenant(s) and/or Land Contract Vendee(s) of 54 Dover Street, Dayton, Ohio 45410; and The Unknown Heirs, Legatees and Devisees of Lakisha DeWitt, if she is deceased, whose addresses are unknown, will hereby take notice that on the 27th day of October, 2010, Oberer Land Developer, LTD filed its compliant in the Common Pleas Court of Montgomery County, Ohio, being Case No. 2010CV08497 in said Court against said persons and/or entities, praying for a finding that Oberer Land Developers, LTD, is entitled to the real estate taxes that it has paid as purchaser of a Real Estate Tax Certificate under ORC Section 5721.32 and for an Order of Sale under ORC Section 5721.39 of the real estate described in Exhibit "A" as follows: Situated in the City of Dayton in the County of Montgomery in the State of Ohio and being eleven (11) feet taken by parallel lines off the south side of Lot Numbered Fourteen Thousand Five Hundred Seventy (14570) and eleven (11) feet taken by parallel lines off the North side of Lot Numbered Fourteen Thousand Five Hundred Seventy One (14571), both of said lot numbers being the consecutive numbers of lots on the revised plat of the said City of Dayton, Ohio: EXCEPTING THEREFROM that portion conveyed to The Dayton Street Railway Company in two tracks by deeds of October 21, 1907 and August 15, 1908, being recorded in the Deed Records of Montgomery County, Ohio in Deed Book 302, Page 20 and in Deed Book 306, Page 259, respectively, and described as follows: Situated in the City of Dayton, County of Montgomery and State of Ohio and being the Southeast portion of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14570) and the Northeast part of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14571); more particularly described as follows: Beginning on the East line of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14570) at a point thirty two (32) feet South of the Northeast corner of said Lot; thence in a Southwesterly direction crossing the South line of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14570) and extending to a point on the South line of the North eleven (11) feet of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14571), said point being fifty (50) feet West of the East line of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14571), or thirty eight (38) feet west of the southwest point of the part owned by The Dayton Street Railway Company; thence Eastwardly along the south line of said eleven (11) foot portion of said Lot Numbered fourteen Thousand Five Hundred Seventy One (14571), fifty (50) feet to the East line of said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14571); thence Northwardly along the East line of said Lots Numbered Fourteen Thousand Five Hundred Seventy (14570) and Fourteen Thousand Five Hundred Seventy One (14571), twelve (12) feet; (being eleven (11) feet off both said Lot Numbered Fourteen Thousand Five Hundred Seventy One (14571) and one (1) foot off of said Lot Numbered Fourteen Thousand Five Hundred Seventy (14570) to the place of beginning - being the same real estate described in deed recorded in Deed Book 1757, page 512 of the Deed Records of Montgomery County, Ohio. Parcel Number: R72-024-03-0023 and R72-024-03-0024 Address: 54 Dover Street, Dayton, Ohio 45410 that the aforementioned persons and/or entities be required to set up any interest they have in said premises or be forever barred; and upon failure of any of said persons and/or entities to pay or cause to be paid said amount due to Oberer Land Developers, LTD, within three days from its rendition that an Order of Sale be issued to the Sheriff of Montgomery County, Ohio, to appraise, advertise and sell said real estate free and clear of all claims, liens, and interest of any of the parties herein, and that the proceeds from the sale of said real estate be applied to the amount due Oberer Land Developers, LTD and for such other relief to which Oberer Land Developers, Ltd is entitled. Said persons and/or entities will take notice that they are required to answer said complaint on or before the 3rd day of January, 2011, or judgment will be rendered accordingly.
