  • LEGAL NOTICE In the Common Pleas Court of Montgomery County, Dayton, Ohio. Case No. 2010CV07157. PNC BANK, N.A. SUCCESSOR BY MERGER WITH NATIONAL CITY BANK, Plaintiff vs. JEROME T. MCGARVEY, et al., Defendants Jane Doe, Unknown Spouse, if any, of Jerome T. McGarvey, whose last known address is unknown, will take notice that on the 9th day of September, 2010, PNC Bank, N.A. Successor by merger with National City Bank filed its Complaint in Case Number 2010CV07157 in the Montgomery County Common Pleas Court, alleging that Defendant(s) have or claim to have an interest in the real estate commonly known as 1716 Salem Avenue, Dayton, Ohio 45425, and also known as Parcel Number R72-118-06-0013 of the Auditor's Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's mortgage filed as Instrument Number 03-118-06-0013 of the Auditor's Records of Montgomery County, Ohio. Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's mortgage filed in Microfiche Number 03-095089, on the 30th day of June, 2003 in the Recorder's Office of Montgomery County, Ohio. The Complaint further alleges that by reason of default of the Defendant(s) Jerome T. McGarvey in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of Plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable. The Defendant(s) named upon are required to answer on or before the 28th day of December, 2010, or a judgment may be rendered as prayed for herein. Robert K.
