City of Trotwood, 3035 North Olive Road, Trotwood, Ohio 45426, Plaintiff -vs- Continental REO, LLC, et al, Defendants Continental REO, LLC, whose last known address is 770 East Main Street #359, Lehi, Utah 84043, and Unknown Occupants whose last known address is 4016 Annapolis, Trotwood, Ohio 45416 whose addresses are unknown and cannot by reasonable diligence by ascertained, will take notice that on June 25, 2010, State of Ohio, ex rel. City of Trotwood, filed its Complaint to Abate Nuisance, For Injunction Against Nuisance and For Damages in the Common Pleas Court of Montgomery County, Ohio in Case No. 2010CV05124. Property Address: 4016 Annapolis, Trotwood, Ohio 45416 and being more particularly described as follows: Situate in Section 13, Town 4, Range 5E, City of Trotwood, Montgomery County, Ohio and being all of Lot ll0l of Fort McKinley Plat Maplewood Addition as recorded in Plat Book I, Page 48 of the Plat Records of said County, part of a vacated alley described in Book 1105, Page 146 of the Deed Records of said County, and part of a vacated alley described in Book 1245, Page 594 of the Deed Records of said County, and being all of the tract conveyed to John E. Booth and Shimeca Booth by Deed recorded in Microfiche 00-769B07 of the Deed Records of said County, said part of vacated alleys being more particularly described as follows: Part of Alley vacated in Deed Book 1105, Page 146: Beginning at a 5/8" iron pin found at the northwest corner of Salem and Annapolis Replat as recorded in Book 158, Page 7 of the Plat Records of said County: Thence from said point of beginning, S 18 deg. 17' 46" E with the west line of said Salem & Annapolis Replat a distance of 147.53 feet to a 5/8" iron pin set at the southeast corner of said Lot 1101; thence N 24 deg.31'18" W with the East line of said Lot 1101 a distance of 154.06 feet to a 5/8" iron pin found at the northeast corner of said Lot 1101; thence S 89 deg. 41'31" E with the South line of Annapolis Avenue (40') a distance of 17.63 feet to the point of beginning, containing 0.028 acres more or less. Part of Alley vacated in Deed Book 1245 Pages 594: Beginning at a 5/8" iron pin found at the southwest corner of said Salem & Annapolis Replat, said point also being on the North line of a tract conveyed to Auto Zone, Inc. by Deeds recorded in Microfiche 92-705A05; Thence from said point of beginning S 89 deg. 58'29" W with the north line of said Auto Zone, Inc. tract a distance of 100.64 feet to a 5/8" iron pin set at the southeast corner of a tract conveyed to Dennis J. Dugan and Wilma J. Dugan by Deed recorded in Microfiche 98-841A11 of the Deed Records of said County; thence N 00 deg. 01'31" W with the east line of said Dugan tract a distance of 8.00 feet to a 5/8" iron pin set at the southeast corner of Lot 1100 of said Fort McKinley Plat and the Southwest corner of said Lot 1101; thence N 89 deg. 58'29" E with the Southwest corner of said Lot 1101; thence N 89 deg.58'29" E with the South line of Lot 1101 a distance of 98.00 feet to a 5/8" iron pin set at the southeast corner of Lot 1101. Said point also being on the West line of said Salem-Annapolis Replat; thence S 18 deg. 17'46" E with said South line a distance of 8.42 feet to the point of beginning, continuing 0.018 acres more or less. The total acreage of the above described tract is 0.255 acres, more or less. Basis of Bearing South line of Annapolis Avenue per Salem & Annapolis Replat, Plat Book 158, Page 7 S 89 deg.41'31" E. The above description is the result of a field survey prepared by Raymond B. Mefford, Ohio Registered Surveyor No. 7367, and Judge Engineering Company, dated August 27, 2004. The above named defendants are required to answer within twenty-eight (28) days after the last publication which shall be published once a week for six consecutive weeks, or it might be denied a hearing in this case.
