Case No. 2010CV07365 Fifth Third Mortgage Company, Plaintiff vs. Raymond E Mincer, et al., Defendants Defendant, Joyce A Mincer, whose last known address is 7115 Fallen Oak Trace, Dayton, OH 45459, will take notice that on September 15, 2010, Fifth Third Mortgage Company, filed their Complaint in Case No. 2010CV07365, in the Court of Common Pleas of Montgomery County, Ohio, alleging that the defendant, Joyce A Mincer, has or claims to have an interest in the real estate described below: PREMISES COMMONLY KNOWN AS: 7115 Fallen Oak Trace, Dayton, Ohio 45459. PREMISSES COMMONLY KNOWN AS: O68-50706-0034 The plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute. The plaintiff demands that the defendant named above be required to answer and set up his interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable. The defendant named above is required to answer on or before the 6th day of December, 2010.
