Case No. 2010CV01909 BAC Home Loans Servicing, L.P. fka Countrywide Home Loans Servicing, L.P., Plaintiff vs. Southwestern Ohio Investments, LTD, et al., Defendant Defendant, Southwestern Ohio Investments, LTD, whose Statutory Agent's last known address is 6 North Main Street, #400, Dayton, Ohio 45402, will take notice that on March 4, 2010, BAC Home Loans Servicing, L.P. fka Countrywide Home Loans Servicing, L.P., filed their Complaint in Case No. 2010CV01909, in the Court of Common Pleas of Montgomery County, Ohio, alleging that the defendant, Southwestern Ohio Investments, LTD, has or claims to have an interest in the real estate described below: PREMISES COMMONLY KNOWN AS: 207 CLOVER STREET, DAYTON, OHIO 45410 PERMANENT PARCEL NUMBER: R72-02602-0044. The plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute. The plaintiff demands that the defendant named above be required to answer and set up his interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.
