Helmers, whose last known address is 910 Chelsea Avenue, Dayton, Ohio 45410, will take notice that on February 23, 2010, RBS Citizens NA, fka Citizens Bank NA, sbm to Charter One Bank NA, filed their Complaint in Case No. 2010CV01587, in the Court of Common Pleas of Montgomery County, Ohio, alleging that the defendants, Brian J. Helmers and Jane Doe, Real Name Unknown, the Unknown Spouse, if any, of Brian J. Helmers, have or claim to have an interest in the real estate described below: PREMISES COMMONLY KNOWN AS: 28 VIRGINIA AVENUE, DAYTON, OHIO 45410 PERMANENT PARCEL NUMBER: R72-03501-0049 The plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute. The plaintiff demands that the defendant named above be required to answer and set up his interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.
