In pursuance of an order issued from Common Pleas Court, within and for the County of Montgomery, State of Ohio, made at the January term thereof, 2010, and to me directed, I will offer for sale at Public Auction in the Lower Level Auditorium of the Montgomery County Administration Building, 451 West Third Street in the City of Dayton, Ohio 45402 on Friday, at 10 o'clock A.M. of said day, the following Real Estate, to-wit: Situate in the Township of Harrison, County of Montgomery, State of Ohio, and being Unit Numbered 2 on the Townhouses of Catalpa, Phase I Condominium, as recorded in Plat Book "93", page 37 of the Plat Records of Montgomery County, ohio, and as described in the Declaration of Condominium Ownership recorded in Microfiche no. 72-665-B07 of the Records of Montgomery County, Ohio, together with an undivided common ownership in the common areas and facilities as defined in the aforesaid Declaration of Condominum as an appurtenance to the above unit. Parcel No. E20-501-12-0002 Prior Deed Reference: Instrument ID No. 06-094930. Improved with 2 story condo, wood exterior, slab, 5 room (2 bedroom, 2.5 bath) gas forced heat, central air, built in 1973. Located at 4663 Merrick Drive, Dayton, Ohio 45415. Said property has been appraised at $36,000.00 and cannot sell for less than two-thirds of appraisement. This appraisal is based upon a visual inspection of that part of the premises to which access was readily available. The appraisal did not include an examination of the interior of the property. The appraisers assume no responsibility for, and give no weight to, unknown legal matters, including, but not limited to, concealed or latent defects, and/or the presence of harmful or toxic chemicals, pollutants, or gases. Terms of Sale: The successful bidder must deposit 10% of the purchase price plus transfer and recording fees immediately following the sale. We will accept cash, certified check or a personal check with proper ID and signed in our presence for the deposit. The personal check must be drawn off of a local bank. If you wish to put the property in a persons name not attending the sale you must have power of attorney to do so. The required 10% deposit is waived where the purchaser is the first lienholder. The unpaid balance of the purchase price must be paid to the Montgomery County Sheriff by certified or cashier's check within thirty (30) days of the filing of the confirmation entry.
