Claims of wrongful imprisonment must start in common pleas court

The Supreme Court of Ohio last week spelled out the process in which a
prison inmate may make a claim of wrongful imprisonment. The 6-0 ruling
by the court clarified that an inmate must first bring an action in the
court of common pleas to secure a determination that he is a wrongfully
imprisoned individual entitled to compensation.Then, the claimant must
file a civil action against the state, in the Ohio Court of Claims, to
recover a sum of money as established in Walden v. State (1989), 47 Ohio
St.3d 47, 547 N.E.2d 962.
