Court holds litigation participation does not waive insufficient service defense

In a near unanimous decision Wednesday, August 8th, the Supreme Court of Ohio held that when a defendant in a civil case has properly raised and preserved the affirmative defense that it did not receive sufficient service of the plaintiff's complaint, the defendant's active participation in the litigation does not constitute a warrant of the failure of service defense.
