Court upholds decision favoring parents in dispute with school administrator

A panel of three judges in the federal 6th Circuit Court of Appeals recently ruled that the United States District Court for the Southern District of Ohio properly denied qualified immunity to a school official who was sued for allegedly filing a child abuse report in retaliation for a parent’s advocacy to change his daughter’s educational plan.
