Judges rule discovery of evidence not unavoidably prevented

A 10th District Court of Appeals panel recently held that a trial court properly dismissed Kim Anderson's motion for a new trial because it found he was not unavoidably prevented from discovering the evidence he contended would support his claims of innocence.
