A civil complaint, United States v. 9520 Cutler Trace, Case No. 3:07CV217, seeking forfeiture pursuant to 18 U.S.C §981(a)(1)(A) and (C) of the Defendant real and personal property was filed on June 14, 2007, in the United States District Court for the Southern District of Ohio, Western Division at Dayton, Ohio. The Defendants to be effected are (1) 9520 Cutler Trace, Dayton, Ohio, (2) Lot 12, 9621 Tai Trace, Centerville, Ohio, (3) Lot 32, 9635 Tai Trace, Centerville, Ohio, (4) 89.495 Acres in Waynesville, Ohio, (5) 53.9 acres in Waynesville, Ohio, (6) Unit "N", 8331 Highway A1A, Melbourne Beach, Florida, 32951, (7) Unit B406, 703 Solana Shores Drive, Cape Canaveral, Florida, 32920, (8) Oak Hill Account #1445 in the name of Michael Peppel, (9) RBC Centura Account #6011 in the name of Lynn Peppel, (10) Credit Suisse Account #5966 in the name of Lynn Peppel, (11) Credit Suisse Account #5251 in the name of Natalie Peppel C/F Michael E. Peppel, Jr., (12) Credit Suisse Account #5319 in the name of Natalie Peppel C/F Marissa C. Peppel, (13) Credit Suisse Account #0901 in the name of Natalie Peppel C/F Maxwell V. Peppel, (14) Charles Schwab Account #8292 in the name of Lalit P. Dhadphale, (15) Art in the form of a bronze sculpture by Ludovico DeLuigi, and (16) Art in the form of an oil painting entitled "Ento ca D'oro" by Ludovico DeLuigi. The complaint alleges that the Defendants, may, for the causes stated in the complaint, be forfeited to the United States. The Complaint may be obtained from the Office of the Clerk, United States District Court for the Southern District of Ohio, Western Division, at 712 Federal Building, 200 West Second Street, Dayton, Ohio 45402. In order to avoid forfeiture of the Defendant real and personal property, any person claiming an interest in the currency must file a verified "Claim" with the Office of the Clerk of the District Court, 712 Federal Building, 200 West Second Street, Dayton, Ohio 45402, in accordance with 18 U.S.C §983(a)(4)(A) and Rule G of the Supplemental Rules for Certain Admiralty or Maritime and Asset Forfeiture Claims. The Claim must be must be filed within 30 days after the date of final publication of this Notice, or within the deadline imposed in the Notice sent directly to all known potential Claimants. The Claim must (1) identify the specific property claimed, (2) identify the Claimant and state the Claimant's interest in the property; (3) be signed by the Claimant under penalty of perjury, and (4) be served on Gregory Lockhart, United States Attorney, at 602 Federal Building, 200 West Second Street, Dayton, Ohio 45402. In addition to filing a Claim, all Claimants must file an Answer or Motion under Rule 12 of the Federal Rules of Civil Procedure, to the Complaint, with the District Court Clerk, not later than 20 days after filing their Claim.
